Drunk Driving Laws

Drunk Driving Laws Drunk driving laws in the United States have placed the maximum threshold for blood alcohol content (BAC) at .08.

Some drivers argue the drunk driving laws are pressing against personal freedoms. In many cases drivers have felt they were able to operate a motor vehicle when the law was .10 and they wonder why they are subjected to a reduction.

Others argue the drunk driving laws of the United States may not be as strong as they should be in comparison with many countries that maintain drunk driving laws that in some cases do not allow anyone who's been drinking to operate a motor vehicle. Other countries have a threshold that is less than half the level of America's current laws.

Statistics indicate the current drunk driving laws are saving lives and supporters of current law feel this makes the strongest case.

Pro

  • A lower blood alcohol content (BAC) has proven to reduce traffic related fatalities due to alcohol impairment.
  • Works to instill a sense of responsibility among those who choose to consume alcohol.
  • Is not unduly restrictive when compared to other countries.
  • Seeks to provide the safest atmosphere on American roads possible.

Con

  • Is more restrictive than in the past and seems to penalize those who were law abiding citizens under the previous law.
  • Penalties for driving under the influence have also become more restrictive causing further frustration among social drinkers.
  • Reminds some of the atmosphere of prohibition.
  • Is often considered arbitrary because the law can never be fully enforced, but when it is the punishment can be severe.
